Inktavo Privacy Policy

This Privacy Policy describes how Inktavo and its family of companies (“Inktavo,” “we,” “us,” or “our”) collect, use, disclose, and safeguard information that can be reasonably linked to an individual (“Personal Information”).  This Privacy Policy applies to all of our websites, including www.inktavo.com, www.inksoft.com, www.printavo.com, and www.graphicsflow.com (the “Sites“).  A reference to “you” or “your” means the user of the Sites, or if applicable, the company or legal entity you represent.  This Privacy Policy also tells you about your rights and choices with respect to your Personal Information and how you can reach us to get answers to your questions.

Cookies and Other Tracking Technology

We use Cookies to enable our servers to recognize your web browser, tell us how and when you visit and use our Services, analyze trends, learn about our user base and operate and improve our Services.  Cookies are small pieces of data – usually text files – placed on your computer, tablet, phone or similar device when you use that device to access our Services.  We may also supplement the information we collect from you with information received from third parties, including third parties that have placed their own Cookies on your device(s).  Please note that because of our use of Cookies, the Services do not support “Do Not Track” requests sent from a browser at this time.

Information about Interest-Based Advertisements

We may serve advertisements, and also allow third-party ad networks, including third-party ad servers, ad agencies, ad technology vendors and research firms, to serve advertisements through the Services.  These advertisements may be targeted to users who fit certain general profile categories or display certain preferences or behaviors (“Interest-Based Ads”).  Information for Interest-Based Ads (including Personal Information) may be provided to us by you, or derived from the usage patterns of particular users on the Services and/or services of third parties.  Such information may be gathered through tracking users’ activities across time and unaffiliated properties, including when you leave the Services.  To accomplish this, we or our service providers may deliver Cookies, including a file (known as a “web beacon”) from an ad network to you through the Services.  Web beacons allow ad networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers.  Web beacons also enable ad networks to serve targeted advertisements to you when you visit other websites.  Web beacons allow ad networks to view, edit or set their own Cookies on your browser, just as if you had requested a web page from their site.

You can decide whether or not to accept Cookies through your internet browser’s settings.  Many browsers have an option for turning off the Cookie feature, which will prevent your browser from accepting new Cookies, as well as (depending on the sophistication of your browser software) allow you to decide on acceptance of each new Cookie in a variety of ways.  You can also delete all Cookies that are already on your device.  If you do this, however, you may have to manually adjust some preferences every time you visit our Sites and some of the Services and functionalities may not work.

Social Media Features

Our Sites may use social media features or plugins, such as the Facebook “like” button, the Twitter “Tweet” button and other sharing widgets (“Social Media Features”).  You may be given the option by such Social Media Features to post information about your activities on a website to a profile page of yours that is provided by a third-party social media network in order to share with others within your network.  Social Media Features are either hosted by the respective social media network or hosted directly on our Sites.  To the extent the Social Media Features are hosted by the respective social media networks, the latter may receive information that you have visited our Sites from your IP address.  If you are logged into your social media account, it is possible that the respective social media network can link your visit of our Sites with your social media profile.  Your interactions with Social Media Features are governed by the privacy policies of the companies providing the relevant Social Media Features. 

Your Choices

You may be able to review and edit the personal information you have provided to us by logging into your account and editing the information directly in your account.

Additionally, depending on your location and local law, you may be entitled make the following choices regarding your Personal Information:

  1. Know or Access to Your Personal Information.  You may request access to your Personal Information by contacting us at the address described below.  If required by law, upon request, we will grant you reasonable access to the Personal Information that we have collected, used, disclosed, and sold about you, including the categories of Personal Information, the categories of sources from which the Personal Information is collected, the business or commercial purpose for collecting, selling, or sharing Personal Information, the categories of third parties to whom Inktavo discloses Personal Information, and the specific pieces of Personal Information Inktavo has collected about you.  Note that California residents may be entitled to ask us for a notice describing what categories of Personal Information (if any) we share with third parties or affiliates for direct marketing.  Residents of Canada are entitled to ask about the specific personal information we hold, how we use and disclose it, and to update or correct that information.  You may submit such a request as described below.
  2. Obtain a copy of Personal Information.  You may obtain a copy of personal information we have about you in a portable and, to the extent technically feasible, readily usable format. You may submit such a request as described below.
  3. Changes or Corrections to Your Personal Information.  We rely on you to update and correct your Personal Information.  Please review your personal and contact information regularly in order to ensure it’s up to date.  If you need additional assistance, you may submit a request to correct your personal information as described below. 
  4. Deletion of Your Personal Information.  You may request that we delete your Personal Information by submitting a request as described below.  If required by law we will grant a request to delete information, but please note that in many situations we must keep your Personal Information to comply with our legal obligations, resolve disputes, enforce our agreements, or for another one of our business purposes.  
  5. Opt-out of Sharing Your Personal Information.  You may opt out of the sharing of your Personal Information for purposes of targeted advertising (also called cross-context behavioral advertising and/or the profiling in furtherance of decisions that produce legal or similarly significant effects, which you can exercise by visiting the Inktavo Subscription Center or by modifying your privacy preferences (e.g., Global Privacy Control), available through certain internet browsers and extensions, that signal your preference to opt out.  Please note that clearing your cookies at any time will remove the signal of your selected privacy preferences.  You may submit a request by submitting a request as described below.
  6. Promotional Emails.  You may choose to provide us with your email address for the purpose of allowing us to send free newsletters, surveys, offers, and other promotional materials to you, as well as targeted offers from third parties.  You can stop receiving promotional emails by following the unsubscribe instructions in e-mails that you receive.  If you decide not to receive promotional emails, we may still send you service-related communications. 
  7. Promotional Mailings.  If at any time you do not want to receive offers and/or circulars from us you can remove yourself from our mailing lists by emailing us (our contact information is below) with “Remove from Mailing List” in the subject line along with your name, address, and zip code.  Please note that our mailings are prepared in advance of their being sent.  Although we will remove your name from our mailing list after receiving your request, you may still receive mailings from us that had been initiated prior to your name being removed.
  8. Promotional Text Messages.  If you receive a text message from us that contains promotional information you can opt-out of receiving future text messages by replying “STOP.”
  9. Revocation Of Consent.  If you revoke your consent for the processing of Personal Information, then we may no longer be able to provide you services.  In some cases, we may limit or deny your request to revoke consent if the law permits or requires us to do so, or if we are unable to adequately verify your identity.  You may revoke consent to processing (where such processing is based upon consent) by contacting us at the address provided below.

In addition, and as set forth below, California law requires us to identify, for the 12-month period prior to the date of this Privacy Policy, what information we may have “sold” or “shared” about you. For the 12-month period prior to the date of this Privacy Policy, Inktavo not sold any Personal Information about its customers. For the 12-month period prior to the date of this Privacy Policy, Inktavo has only shared Personal Information about its customers as described above. Inktavo does not use or disclose Sensitive Personal Information, as defined in applicable laws, for any purposes other than those permitted by applicable law. 

Opt-Out Preference Signals:  We are working towards enabling Global Privacy Control (GPC) as an additional way for you to submit a request to opt-out of the sale and sharing of your personal information through browsers and/or browser extensions that support such a signal.  Until then, you can opt-out of the use of third-party cookies for personalized advertising by setting your cookie preferences on your browser.

This Privacy Policy describes how we may share your information for marketing purposes, as described above. If you are a California resident, the Shine the Light law permits you to request and obtain from us once per calendar year information about any of your Personal Information shared with third parties for their own direct marketing purposes, including the categories of information and the names and addresses of those businesses with which we have shared such information. California Business Contact Information

If you are a California resident and we receive your Personal Information in the form of contact details from business events, for example as part of a business appointment (e.g., by exchanging business cards) or as part of any other form of collaboration, we may use your contact and business details to maintain our business contacts. For this purpose, we may transfer your contact details to our internal database.   

The processing activity may include the following categories of Personal Information:

This data processing is based on our legitimate business interests. We have a legitimate economic interest in maintaining contacts beyond the initial context and in using them to establish and develop a business relationship and to remain in contact with the parties concerned.  Such business contacts could also be easily processed in our email communications with you and then kept in typical business software, either centrally or on the electronic devices of our employees.  

We do not sell or share any of our data subjects’/consumers’ Personal Information, as defined by the CCPA.  California law requires us to identify, for the 12-month period prior to the date of this Privacy Policy, what information we may have “sold” or “shared” about you. For the 12-month period prior to the date of this Privacy Policy, we have not sold or shared any personal information about our business contacts, nor have we used or disclosed their sensitive personal information, as defined in applicable laws and to the extend we have collected any, for any purposes other than those permitted by applicable law.

Submitting Requests

If you are a resident of California, you may submit your requests to opt out, correct, delete, and/or to know/obtain Personal Information we have collected about you by contacting the Company via our Toll-Free Telephone Number at: (800) 213 - 9317 or privacy@inktavo.com.

We will respond to your request in compliance with the requirements of your state’s applicable laws.  Please note that we are only required to honor California requests to know twice in a 12-month period.

Verification of Your Identity

When you exercise these rights and submit a request to us, we may verify your identity by phone call or email.  Depending on your request, we will ask for information such as your name and date of subscription.  We may also ask you to provide a signed declaration confirming your identity.  We also may use a third-party verification provider to verify your identity.

Non-Discrimination

If you make a request under the CCPA, we will not discriminate against you in any way.  For example, we will not deny you discounts or other benefits or impose penalties on you, or provide you with or suggest that you will receive a different level or quality of benefits or services.

Authorized Agents

You may permit an authorized agent to submit a request to know or to delete your Personal Information.  If we receive a request on your behalf, we will ask that person to give us proof that you gave that person written permission to make a request for you.  If that person does not provide us with written proof, we will deny their request so that we can protect your Personal Information.

Automated Decision-Making

We generally do not use automated decision-making technology, as that term is defined by State Privacy Laws. If we make use of automated decision-making technology, you will be informed through a separate privacy notice. 

How We Protect Personal Information

No method of transmission over the Internet, or method of electronic storage, is fully secure.  While we use reasonable efforts to protect your Personal Information from unauthorized access, use, or disclosure, we cannot guarantee the security of your Personal Information.  In the event that applicable law requires us to inform you of a breach relating to Personal Information, we will notify you as required by law, using the methods and within the time periods that apply.

Our Website permits you to create an account.  When you do you will be prompted to create a password.  You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else that has obtained your password, whether or not such access or use has been authorized by you.  You should notify us of any unauthorized use of your password or account.

Data Controller and Data Processor; Data Protection Officer

We process personal data both as a Processor and as a Controller, each as defined in the EU Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 (the “Directive”) and the General Data Protection Regulation (“GDPR”). The Customer which Customer End Users provided personal data to, with the assistance of the Service, will be the Controller for Customer End User Data. We will be the Processor of Customer End User Data. For Customer personal data, we will be the Controller.
